What elements must be proven in a wrongful death?
If you are filing a wrongful death lawsuit, there are several elements that must be proven before you can receive the compensation you are entitled to as the surviving family of the deceased. In order to file a wrongful death lawsuit, you must first prove that you are the surviving family and are entitled to compensation.
In order to file a wrongful death lawsuit, you must be one of the following:
- A child or a stepchild and the deceased acted as your parent
- A parent of the deceased or a stepparent or grandparent
- A spouse married to the deceased at the time the wrongful death occurred
- Someone who lived with the deceased for over two years and had a marriage-like relationship with the deceased
The additional elements you must prove in a wrongful death case are:
- The deceased was a human being
- The death was caused by the malicious behavior, willful intent, intentional behavior, or negligent behavior of another
- The surviving family incurred losses due to the result of the death
- The death could have been prevented

Statutes of Limitation in Wrongful Death Cases
The statute of limitations in wrongful death cases is two years. This is a short amount of time to give the surviving family to accept the death of their loved one, to grieve, to lay the loved one to rest, and to begin the legal process to file for the wrongful death case. Filing the wrongful death lawsuit after the expiration of the two years may leave the surviving family without the opportunity to recover entitled compensation and hold responsible the party who caused the wrongful death.
The Vancouver, BC, wrongful death lawyers at Stephens & Holman understand that this is a difficult time for their clients. They care about your loss and are here to protect your rights.
