What elements must be proven in a wrongful death?

In order to file a wrongful death lawsuit, you must first prove that you are the surviving family and are entitled to compensation.
In order to file a wrongful death lawsuit, you must be one of the following:
- A child or a stepchild and the deceased acted as your parent
- A parent of the deceased or a stepparent or grandparent
- A spouse married to the deceased at the time the wrongful death occurred
- Someone who lived with the deceased for over two years and had a marriage-like relationship with the deceased
The additional elements you must prove in a wrongful death case are:
- The deceased was a human being
- The death was caused by the malicious behavior, willful intent, intentional behavior, or negligent behavior of another
