Pedestrian Accidents, Bicycle Accidents, and ICBC in British Columbia
If you are
a pedestrian
or bicyclist
and have been struck by a negligent driver, you may have an ICBC claim even
though you were not driving or riding in a motor vehicle at the time. Pedestrian
and bicycle accidents in British Columbia are usually straightforward personal
injury claims.
If you were
a passenger or driver of a motor vehicle and were injured in an accident caused
by a cyclist or pedestrian, ICBC may still be involved in your claim – but the
claim itself will be more complicated. In these types of accidents, ICBC is
typically involved in the payment of Part VII benefits, as well as compensation
for any injuries you suffered in the accident.
In many
cases, at-fault pedestrians and bicyclists do not have the insurance or
personal assets necessary to cover the damages in a personal injury claim filed
by an injured passenger or motorist. If you find yourself in this situation,
ICBC will be involved in your claim under the uninsured and underinsured
motorist provisions (“UMP”).

ICBC Payout Denied for Designated Driver in British Columbia DUI Accident
Following a
Supreme Court ruling on Monday, a designated driver who suffered serious
injuries in a British
Columbia car accident caused by her drunken passenger has been denied
compensation by ICBC. In 2006, the woman was driving her intoxicated boyfriend
home from a soccer game when he grabbed the steering wheel from the passenger
seat and caused the vehicle to crash on Highway 1 in Abbotsford. She was badly
injured, and her boyfriend was killed in the single-vehicle accident.
A British
Columbia Supreme Court justice ruled in favour of ICBC since the woman was not
covered by third-party insurance. Unless she files and wins an appeal, she will
receive no compensation from ICBC for the accident. Eight years after the
accident, she is still not able to work, and her injuries remain an ongoing
source of difficulty in her life.
It is not
yet clear how this ruling will affect organizations that offer rides to
intoxicated patrons. One such organization, Operation Red Nose, states that
they are reviewing the decision. Mothers Against Drunk Driving and ICBC’s legal
team are also taking a close look at the impact this ruling may have on future
similar cases.
If you have
been seriously injured in a drunk driving accident, you deserve justice and
compensation for your losses. Please contact Stephens &
Holman today or call toll free (866) 200-3575 for free advice on your
personal injury claim. We represent injured accident victims in Delta, Langley,
