Pedestrian Accidents, Bicycle Accidents, and ICBC in British Columbia

ICBC Payout Denied for Designated Driver in British Columbia DUI Accident

 Following a Supreme Court ruling on Monday, a designated driver who suffered serious injuries in a British Columbia car accident caused by her drunken passenger has been denied compensation by ICBC. In 2006, the woman was driving her intoxicated boyfriend home from a soccer game when he grabbed the steering wheel from the passenger seat and caused the vehicle to crash on Highway 1 in Abbotsford. She was badly injured, and her boyfriend was killed in the single-vehicle accident.


A British Columbia Supreme Court justice ruled in favour of ICBC since the woman was not covered by third-party insurance. Unless she files and wins an appeal, she will receive no compensation from ICBC for the accident. Eight years after the accident, she is still not able to work, and her injuries remain an ongoing source of difficulty in her life.

It is not yet clear how this ruling will affect organizations that offer rides to intoxicated patrons. One such organization, Operation Red Nose, states that they are reviewing the decision. Mothers Against Drunk Driving and ICBC’s legal team are also taking a close look at the impact this ruling may have on future similar cases.
