Liability in a Truck Accident
Today’s roadways are seeing more and more trucks and there are more trucking accidents than ever before. The drivers of these large vehicles know the risk that they present to the roadways, yet many of them continue to drive carelessly and endanger the lives of other drivers.
Truck drivers are required by law to follow certain regulations regarding cargo and the weight of their truck. They are also responsible for keeping their truck maintained and in proper working order. If the truck driver neglects to follow these rules, there are severe penalties.
If you are in an accident with a truck and the accident is a result of the other driver’s negligence, you can hold the driver or the trucking company liable for your damages. Typically the driver is automatically held liable, but depending on the specifics of the accident, the company who owns the truck can also be held liable. There are also times when the accident was caused by defective parts on the truck and in those cases the manufacturer can be held liable as well.
